The Secretary of State for Health makes the following Order in exercise of the power conferred by sections 65J(2) and 272(7) of the National Health Service Act 2006(1).

In accordance with section 65J(2) of that Act, the Secretary of State considers that it is not reasonable in the circumstances for the trust special administrator appointed pursuant to the South London Healthcare National Health Service Trust (Appointment of Trust Special Administrator) Order 2012(2) to be required to carry out the duty to provide a draft report within the period specified in section 65F(1) of that Act.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the South London Healthcare National Health Service Trust (Extension of Time for Trust Special Administrator to Provide a Draft Report) Order 2012 and comes into force on 16th July 2012.

(2) In this Order, “the Act” means the National Health Service Act 2006.

Extension of time to provide a draft report to the Secretary of State

2.  In relation to the trust special administrator appointed pursuant to the South London Healthcare National Health Service Trust (Appointment of Trust Special Administrator) Order 2012, the period specified in section 65F(1) of the Act is extended from 45 working days beginning with the day on which the appointment of that trust special administrator takes effect to 75 working days from that date.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision for an extension of the period within which the trust special administrator appointed for the South London Healthcare National Health Service Trust must provide a draft report to the Secretary of State. The period is extended by 30 working days from 45 working days beginning with the day on which the administrator’s appointment takes effect to 75 working days from that date.

That draft report to the Secretary of State must state the action which the trust special administrator recommends the Secretary of State should take in relation to the South London Healthcare National Health Service Trust.
