The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 33C(3), 33N(2) and (3) and 89(4) of the Further and Higher Education Act 1992(1):
1992 c.13. Sections 33C and 33N of the Further and Higher Education Act 1992 (“the Act”) were inserted by paragraphs 1 and 3 of Schedule 8 to the Apprenticeships, Skills, Children and Learning Act 2009 (“the 2009 Act”) (c.22) and were amended by paragraphs 1, 11 and 20 of Schedule 12 to the Education Act 2011 (c.21). For the definition of “prescribed” see section 579(1) of the Education Act 1996 (c.56). For the definition of “regulations” see section 61 of the Act.
Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Instrument and provides information about its policy objective and policy implications. They aim to make the Statutory Instrument accessible to readers who are not legally qualified accompany any Statutory Instrument or Draft Statutory Instrument laid before Parliament from June 2004 onwards.
