The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by section 29(3) of the Education Act 1996(1) and sections 19 and 54(3) of the Education Act 1997(2).

Citation and commencement

1.  These Regulations may be cited as the Education (School Performance Targets) (England) (Revocation) Regulations 2011 and come into force on 1st September 2011.

Revocation

2.  The Regulations listed in the first column of the Schedule are revoked to the extent set out in the third column.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations revoke the Regulations listed in the Schedule to the extent set out in the Schedule.

The Education (School Performance Targets) (England) Regulations 2004, as amended, (“the 2004 Regulations”) are revoked. The 2004 Regulations require schools to set annual targets in relation to the pupils’ achievements in the final year of key stage 2 and, in relation to pupils in key stage 4, to set targets regarding GCSEs. The 2004 Regulations also require the governing bodies of schools to provide details of the targets to the local authority as soon as practicable after they are set and by no later than 15th January in the relevant school year. Local authorities are required to send to the Secretary of State a list of the targets provided by the governing bodies by no later than 31st January in the relevant school year.

The 2004 Regulations have been amended by the Education (School Performance Targets) (England) (Amendment) Regulations 2005, the Education (School Performance Targets) (England) (Amendment) Regulations 2006, the Education (School Performance Targets) (England) (Amendment) Regulations 2007, the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2008, the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2009 and the Education (Local Authority and School Performance Targets) (Revocation and Amendment) (England) Regulations 2010. These amending Regulations are revoked to the extent set out in the Schedule.

An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
