Her Majesty, in exercise of the powers conferred by section 1 of the Ministers of the Crown Act 19751, is pleased, by and with the advice of Her Privy Council, to order as follows:

Citation and commencement1

This Order may be cited as the Transfer of Functions (Report on the Civil Estate) Order 2011.

This Order comes into force on 13th April 2011.

Transfer of functions2

The functions of the Treasury under section 86 of the Climate Change Act 20082 (report on the civil estate) are transferred to the Minister for the Cabinet Office.

Consequential amendments3

In section 86(1) and (7) of the Climate Change Act 2008, for “Treasury” substitute “Minister for the Cabinet Office”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order transfers from the Treasury to the Minister for the Cabinet Office certain functions relating to the annual report that must be laid before Parliament assessing the progress made towards improving the efficiency and contribution to sustainability of buildings that are part of the civil estate. Article 2 provides for the transfer and article 3 amends section 86 of the Climate Change Act 2008 in consequence.

Nothing in this Order alters the functions of the Welsh Ministers, the Scottish Ministers or the devolved authorities in Northern Ireland.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
