2.—(1) Amend section 2 of the Increase of Fines Act (Northern Ireland) 1967(1) (power to make amendments as a result of the increase and variation of penalties under the Act) as follows.U.K.
(2) In subsection (1) for “The Governor may, by Order in Council” substitute “The Department of Justice may by order”.
(3) In subsection (1)(a) and (b) for “him” substitute “it”.
(4) For subsection (2) substitute—
“(2) No order shall be made by the Department of Justice under this section unless a draft of it has been laid before, and approved by a resolution of, the Assembly.”

1967 c. 29 (N.I.) By virtue of paragraph 8 of Schedule 12 to the Northern Ireland Act 1998 (c. 47) the reference to the making of an Order in Council by the Governor of Northern Ireland is to be construed as a reference to the making of an order by the Secretary of State.
