The A30 Trunk Road (Improvement at M5 Junction 29) Order 2010

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980 (1) and now vested in him (2) and (3):

1.—(1) This Order may be cited as the A30 Trunk Road (Improvement at M5 Junction 29) Order 2010 and shall come into force on 1st April 2010.

(2) In this Order, all measurements of distance are measured along the route of the relevant highway.

2.  The new highway which the Secretary of State proposes to construct along the route described in the Schedule shall become a trunk road from the date when this Order comes into force.

3.  The centre line of the new trunk road is indicated by a heavy black line on the plan numbered HA/10/NOD/005, marked “The A30 Trunk Road (Improvement at M5 Junction 29) Order 2010”, signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

4.  The Secretary of State directs as respects any part of a highway which crosses the route of the new trunk road that—

(a)where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the new trunk road is opened for traffic.

SCHEDULEROUTE OF THE NEW TRUNK ROAD

The route of the new trunk road, marked 1 on the plan, is about 0.34 kilometres (0.21 miles) in overall length, about 60 metres eastwards from a point on the centre line of the M5 southbound exit slip road at its junction with the A30(T) trunk road, to a point about 180 metres north-eastwards from the junction of the same M5 southbound exit slip road and the A30(T) trunk road in the District of East Devon in the County of Devon.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This Order provides a new trunk road junction on the A30(T) trunk road near Junction 29 on the M5 Motorway. The new trunk road junction will improve access to the M5 southbound.
