1. This Order may be cited as the Registration of Civil Partnerships (Fees) (Amendment) Order 2010 and shall come into force on 6th April 2010.
2. The Schedule to the Registration of Civil Partnerships (Fees) Order 2005(3) is amended as follows-
(a)in the entry numbered 1 (attestation by an authorised person of the necessary declaration), in the column with the heading “Fee”, for “£30.00” substitute “£33.50”;
(b)in the entry numbered 2 (attendance of an authorised person at a place other than one provided by the registration authority etc.), in the column with the heading “Fee”, for “£47.00” substitute “£49.00”; and
(c)in the entry numbered 7 (attendance of the civil partnership registrar for the purpose of signing the civil partnership schedule etc.), in the column with the heading “Fee”, for “£47.00” substitute “£80.00”.
3. The Schedule to the Registration of Civil Partnerships (Fees) (No. 2) Order 2005(4) is amended as follows-
(a)in the entry numbered 3(b) (certified copy issued by a registration authority in any case other than at the time of the formation of the civil partnership), in the column with the heading “Fee”, for “£7.00” substitute “£9.00”;
(b)in the entry numbered 4(b) (certified extract issued by a registration authority in any case other than at the time of the formation of the civil partnership), in the column with the heading “Fee”, for “£7.00” substitute “£9.00”;
(c)in the entry numbered 5 (certified copy or certified extract issued by the Registrar General), in the column with the heading “Fee”, for “£7.00” substitute “£9.25”; and
(d)in the entry numbered 6 (giving notice to a registration authority under article 17(2) of the Civil Partnership (Registration Abroad and Certificates) Order 2005 etc.), in the column with the heading “Fee”, for “£30.00” substitute “£33.50”.

This Order amends the Registration of Civil Partnerships (Fees) Order 2005 and the Registration of Civil Partnerships (Fees) (No. 2) Order 2005 by increasing some of the fees payable in relation to the registration of civil partnerships from 6th April 2010.
The fees specified by the Registration of Civil Partnerships (Fees) Order 2005 and which are increased by this Order are those-
(a)for the attestation by an authorised person of the necessary declaration (from £30.00 to £33.50);
(b)for the attendance of an authorised person at a place other than one provided by the registration authority etc. (from £47.00 to £49.00); and
(c)for the attendance of the civil partnership registrar for the purpose of signing the civil partnership schedule etc. (from £47.00 to £80.00).
The fees specified by the Registration of Civil Partnerships (Fees) (No. 2) Order 2005 and which are increased by this Order are those-
(a)for a certified copy issued by a registration authority in any case other than at the time of the formation of the civil partnership (from £7.00 to £9.00);
(b)for a certified extract issued by a registration authority in any case other than at the time of the formation of the civil partnership (from £7.00 to £9.00);
(c)for a certified copy or certified extract issued by the Registrar General (from £7.00 to £9.25); and
(d)for giving notice to a registration authority under article 17(2) of the Civil Partnership (Registration Abroad and Certificates) Order 2005 etc. (from £30.00 to £33.50).
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
Reference to the “Secretary of State” was substituted in section 34(1) of the Civil Partnership Act 2004 by articles 3(1) and 5(1) of, and paragraph 14(b) of Schedule 1 and paragraph 14(b) of Schedule 2 to, the Transfer of Functions (Registration) Order 2008 (S.I. 2008/678).
