Payment by and to returning officers

18.  Section 29 of the 1983 Act(1) (payments by and to returning officers) shall apply for the purposes of a Scottish parliamentary election subject to the following modifications—

(a)any reference to a parliamentary election shall be construed as a reference to a Scottish parliamentary election;

(b)any reference to a returning officer shall be construed as a reference to a CRO and a RRO;

(c)subsections (1) and (2) (expenses in connection with the writ for a parliamentary election) shall be disregarded;

(d)the reference in subsection (5) to “section 30 below” (taxation of returning officer’s account) shall be construed as a reference to article 19;

(e)in subsection (8) (form and submission of returning officer’s accounts), for “Regulations may” substitute “The Secretary of State may by regulations”;

(f)after subsection (8) insert—

(8A) Any order made under subsection (3) and any regulations made under subsection (8) may make different provision in relation to different cases or in relation to different classes of case..

Section 29 was amended by the Representation of the People Act 1991 (c.11), section 1; the 2006 Act, section 68 and S.I. 1991/1728, article 3. It will be amended by the 2000 Political Parties Act, Schedule 21, paragraph 6(3) and the 2006 Act, Schedule 1, paragraph 107(2), but these amendments are not yet in force.
