Marketing agricultural conservation varieties7

The Secretary of State may authorise the marketing of an agricultural conservation variety of seed in accordance with this paragraph.

The seed must be listed as an agricultural conservation variety in the United Kingdom National List.

The seed must be produced from a crop grown in the region of origin specified for the variety in the United Kingdom National List or as authorised by the Secretary of State.

The seed may only be marketed and used in the stated region of origin.

The Secretary of State may limit the total amount of seed authorised in any given year.

The seed must descend from seed produced according to well defined practices for maintenance of the variety.

The seed must comply with the requirements for certification of certified seed provided for in the Directive relating to that seed specified in Schedule 2 with the exception of the requirements in respect of minimum varietal purity and examination.

The seed must have sufficient varietal purity.

The label must contain the words “conservation variety” in addition to the other labelling requirements in these Regulations, but the label must be brown rather than as specified in Schedule 2.
