The Secretary of State makes the following Regulations in exercise of the powers conferred by section 23A(3)(c), (4) and (9) and section 175(1), (4) and (5) of the Social Security Contributions and Benefits Act 1992(1).
A draft of this instrument was laid before and approved by a resolution of each House of Parliament in accordance with section 176(1)(aa) of that Act(2).
The Social Security Advisory Committee has agreed that proposals in respect of these Regulations should not be referred to it(3).
1992 c. 4. Section 23A was inserted by section 3(1) of the Pensions Act 2007 (c. 22).
Section 176(1)(aa) was inserted by paragraph 10 of Schedule 1 to the Pensions Act 2007 (c. 22).
Section 173(1)(b) of the Social Security Administration Act 1992 (c. 5) provides that proposals in respect of regulations which would otherwise be referable to the Social Security Advisory Committee may not be so referred with the agreement of that Committee. These Regulations would otherwise be so referable by virtue of section 172 of that Act.
