The Secretary of State is designated(1) for the purposes of making Regulations under section 2(2) of the European Communities Act 1972(2) in relation to the environment.
It appears to the Secretary of State that it is expedient for any reference to Annex 1, 3, 4 or 5 of Directive 2008/56/EC of the European Parliament and of the Council of 17th June 2008 establishing a framework for Community action in the field of marine environmental policy(3) to be construed as a reference to that Annex as amended from time to time.
The Secretary of State makes these Regulations in exercise of the powers conferred by that section, and by paragraph (1A) of Schedule 2 to the European Communities Act 1972.
