The Children Act 2004 is amended as follows.

In Part 2 for “children’s services authority” and “children’s services authorities” in each place where those words occur substitute “local authority” and “local authorities” respectively.

In section 10(4)(fa)49 omit “in their capacity as a local education authority”.

In section 18—

a

in subsection (2)(a)—

i

insert “education” before “functions”;

ii

omit “in their capacity as a local education authority”;

in subsection (3)(e)—

after “other” insert “education”;

ii

omit “in their capacity as a local education authority”;

for subsection (10) substitute—

In this section—

  • “the appointed day” means such day as the Secretary of State may by order appoint;

  • “education functions” has the meaning given by section 579(1) of the Education Act 1996.

Section 497A of the Education Act 1996 (power to secure proper performance of a local authority’s education functions) applies in relation to the functions of a local authority which are specified in subsection (2) as it applies in relation to a local authority’s education functions.
