1.—(1) Subject to paragraph 11(2), the Code applies in relation to service investigations which begin on or after 31st October 2009.
(2) Nothing in the Code applies to material intercepted in obedience to a warrant issued under section 5 of the Regulation of Investigatory Powers Act 2000(1), or to any copy, as defined in section 15 of that Act, of that material.

Explanatory Memorandum
Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Instrument and provides information about its policy objective and policy implications.
