The Secretary of State, in exercise of the powers conferred by section 97(1) of the Water Resources Act 1991(1) and now vested in the Secretary of State(2), makes the following Order.
The Secretary of State has consulted the Environment Agency in accordance with section 97(3)(3) of that Act.
See section 221(1) for a definition of “the Minister” and “the Ministers”. Functions exercisable by the Minister of Agriculture, Fisheries and Food and the Secretary of State jointly were transferred to the Secretary of State by article 2(3) of the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).
Section 97(3) was amended by the Environment Act 1995 (c. 25), Schedule 22, paragraph 128.
