This Order is made in exercise of the powers conferred by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to the Traffic Management Act 2004(1).
Walsall Metropolitan Borough Council has applied to the Secretary of State for an order to be made under these powers with respect to the whole of its area.
The Secretary of State has consulted the Chief Constable of the West Midlands Police in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.
The Secretary of State considers that part of the area of the Council (being motorways and trunk roads) should not be designated under the Order and has decided to make the Order with the exception of that part.
Accordingly, the Secretary of State for Transport(2) makes this Order.
1. This Order may be cited as the Civil Enforcement of Parking Contraventions (Walsall) Designation Order 2009 and shall come into force on 1st April 2009.
2. The Secretary of State designates the area described in the Schedule as—
(a)a civil enforcement area for parking contraventions; and
(b)a special enforcement area.

Article 2
This Order applies to the area of the Walsall Metropolitan Borough Council with the exception of—
(a)the M6 southbound carriageway from the boundary of the district of South Staffordshire (at Ordnance Survey National Grid reference point SJ979023) to the boundary of the Metropolitan Borough of Sandwell (at Ordnance Survey National Grid reference point SP017954);
(b)the M6 northbound carriageway from the boundary of the Metropolitan Borough of Sandwell (at Ordnance Survey National Grid reference point SP017954) to the boundary of the district of South Staffordshire (at Ordnance Survey National Grid reference point SJ979023);
(c)the section of the southbound M6/M5 link road from Ordnance Survey National Grid reference point SP017956 to the boundary of the Metropolitan Borough of Sandwell (at Ordnance Survey National Grid reference point SP017955);
(d)the section of the northbound M5/M6 link road from the boundary of the Metropolitan Borough of Sandwell (at Ordnance Survey National Grid reference point SP017953) to Ordnance Survey National Grid reference point SP017955;
(e)the M6 Toll from the boundary of the district of Cannock Chase (at Ordnance Survey National Grid Reference point SK030072) to the boundary of the district of Lichfield (at Ordnance Survey National Grid reference point SK033071);
(f)the A5 from the boundary of the district of Cannock Chase (at Ordnance Survey National Grid reference point SK031065) to the boundary of the district of Lichfield (at Ordnance Survey National Grid reference point SK051065); and
(g)the A5 from the boundary of the district of Lichfield (at Ordnance Survey National Grid reference point SK054065) to the boundary of the district of Lichfield (at Ordnance Survey National Grid reference point SK061065).

This Order designates the area of the Walsall Metropolitan Borough Council as a civil enforcement area for parking contraventions, and as a special enforcement area, for the purposes of Part 6 of the Traffic Management Act 2004. Part of the Council’s area (being motorways and trunk roads) has been excluded from the designation.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
The Secretary of State is the “appropriate national authority” as regards England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act.
