The Traffic Management (Royal Borough of Kensington and Chelsea) Permit Scheme Order 2009

The Secretary of State for Transport having approved the Royal Borough of Kensington and Chelsea Permit Scheme under section 34(2) of the Traffic Management Act 2004(1) makes this Order in exercise of the powers conferred by sections 34(4) and (5) and 39(2) of that Act.

Citation and commencement

1.  This Order may be cited as The Traffic Management (Royal Borough of Kensington and Chelsea) Permit Scheme Order 2009 and is to come into effect on 11th January 2010.

Interpretation

2.  In this Order—

“the Royal Borough of Kensington and Chelsea Permit Scheme” means the permit scheme set out in the Schedule to this Order in terms commonly known as the “London Permit Scheme” which was prepared and submitted to the Secretary of State by the Royal Borough of Kensington and Chelsea and has been approved by the Secretary of State; and

“specified streets” has the meaning given by regulation 8 of the Traffic Management Permit Scheme (England) Regulations 2007(2).

Commencement of Permit Scheme

3.  The Royal Borough of Kensington and Chelsea Permit Scheme comes into effect on 11th January 2010.

Application of Part 8 of The Traffic Management Permit Scheme (England) Regulations 2007

4.  Part 8 of the Traffic Management Permit Scheme (England) Regulations 2007 shall apply to the specified streets within the Royal Borough of Kensington and Chelsea Permit Scheme.

Article 2

SCHEDULEROYAL BOROUGH OF KENSINGTON AND CHELSEA PERMIT SCHEME

EXPLANATORY NOTE

(This note is not part of the Order)

This Order gives effect to the Royal Borough of Kensington and Chelsea Permit Scheme.

The Royal Borough of Kensington and Chelsea Permit Scheme is designed to control the carrying out of works in specified streets in Kensington and Chelsea by imposing an obligation to obtain a permit from the Royal Borough of Kensington and Chelsea before undertaking the works.

Article 3 gives effect to the permit scheme, which will come into effect on 11th January 2010. The permit scheme referred to in this article is set out in the Schedule to the Order.

Article 4 applies Part 8 of the Traffic Management Permit Scheme (England) Regulations 2007 (which makes provision for the disapplication and modification of enactments in relation to specified works in specified streets) to the specified works and specified streets within the Royal Borough of Kensington and Chelsea Permit Scheme.

A copy of the Royal Borough of Kensington and Chelsea Permit Scheme is deposited and can be inspected at the offices of the Royal Borough of Kensington and Chelsea, Council Offices, 37 Pembroke Road, London, W8 6PW and is also available to inspect on the London Councils’ website www.londoncouncils.gov.uk.
