Power to require information

36.—(1) An authority listed in paragraph (3) must comply with any request of the Environment Agency to provide information which the Agency reasonably requires in connection with its functions under these regulations.

(2) The Environment Agency and an authority listed in paragraph (3) must comply with a request of a lead local flood authority to provide information reasonably required in connection with the lead local flood authority’s functions under these regulations.

(3) The authorities are—

(a)a lead local flood authority,

(b)a district council for an area for which there is no unitary authority,

(c)an internal drainage board (within the meaning given by section 1 of the Land Drainage Act 1991(1)),

(d)a highway authority (within the meaning given by section 1 of the Highways Act 1980((2)),

(e)a company which holds an appointment under Chapter 1 of Part 2 of the Water Industry Act 1991(3) or a licence under Chapter 1A of Part 2 of that Act,

(f)a reservoir undertaker (within the meaning given by section 1 of the Reservoirs Act 1975(4)),

(g)a navigation authority (within the meaning given by section 219 of the Water Industry Act 1991,

(h)a harbour authority (within the meaning given by section 313 of the Merchant Shipping Act 1995(5)),

(i)Natural England,

(j)the Historic Building and Monuments Commission for England,

(k)the Countryside Council for Wales, and

(l)the Welsh Ministers.

(4) The information must be provided—

(a)in the form or manner specified in the request, and

(b)within the period specified in the request.
