The City of Stoke-on-Trent (Scheme of Elections) Order 2009

The Secretary of State, in exercise of the powers conferred by section 86(A1), (4) and (7) of the Local Government Act 2000(1) makes the following Order:

Citation and commencement

1.  This Order may be cited as the City of Stoke-on-Trent (Scheme of Elections) Order 2009 and shall come into force on 16th November 2009.

Elections of the Council of the City of Stoke-on-Trent

2.—(1) Elections of all councillors for all the wards of the City of Stoke-on-Trent shall be held simultaneously on the ordinary day of election of councillors in 2011(2) and in every fourth year after 2011.

(2) The councillors holding office immediately before the fourth day after the ordinary day of election of councillors in 2011 shall retire on that date and the newly elected councillors shall come into office on that date.

Revocation

3.  Article 3 of the City of Stoke-on-Trent (Electoral Changes) Order 2001(3) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order provides for the holding of the ordinary elections of councillors of all the wards in the City of Stoke-on-Trent simultaneously. It replaces the previous scheme for the ordinary elections of councillors by thirds.

Article 2 provides that elections of all councillors in Stoke-on-Trent are to be held in 2011 and subsequently every four years. It deals with the retirement of existing councillors and the coming into office of newly elected councillors following the elections in 2011.

Article 3 revokes article 3 of the City of Stoke-on-Trent (Electoral Changes) Order 2001 which provides for elections by thirds.
