The Secretary of State, in exercise of the powers conferred by sections 2(5), 40(4) and 42(1)(1) of the Identity Cards Act 2006(2), makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Identity Cards Act 2006 (National Identity Registration Number) Regulations 2009 and shall come into force on 20th October 2009.

Prescribed requirements

2.—(1) The requirements in paragraphs (2) and (3) are prescribed for the purposes of section 2(5) of the Identity Cards Act 2006 (Individuals entered in Register).

(2) A National Identity Registration Number shall provide no information in respect of a person other than that an entry in the Register has been made and that the entry has been given that number.

(3) The process by which a National Identity Registration Number is given to an entry in the Register shall have no regard to any other reference number or code assigned to the person in respect of whom the entry has been made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Section 2(5) of the Identity Cards Act 2006 provides that an entry in the National Identity Register which consists of all the information recorded about a person must be given a unique number known as his National Identity Registration Number, and that this number must comply with prescribed requirements. Regulation 2 prescribes these requirements.

Regulation 2(2) provides that no information about a person is to be provided by his National Identity Registration Number except that an entry in the Register has been made in respect of him, and that his entry has been given this number.

Regulation 2(3) provides that the process of giving a National Identity Registration Number to an entry made in the Register is to have no regard to any existing reference number or code – (for example, a national insurance number or a driver number) – which has already been assigned to the person in respect of whom the entry has been made.
