EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force provisions of the Identity Cards Act 2006 (“the 2006 Act”) on the dates specified in Article 2.

Article 2(1) to (6) brings into force section 2(1) and (2), and section 5(1)(b), of the 2006 Act on various dates. These provisions of the 2006 Act relate to entries being made in the National Identity Register for persons who are entitled to be registered in that Register and who apply for an entry to be made, and how such an application may be made.

Article 2(1) and (4) brings into force section 2(1) and (2), and section 5(1)(b), of the 2006 Act on 20th October 2009 in relation to British citizens or EEA nationals within the four categories set out in paragraphs (a), (b), (c), and (d) of Article 2(4). Paragraph (a) refers to those persons employed by the Identity and Passport Service who work at premises located in the counties of Greater Manchester, Merseyside or Durham, or in a London borough. Paragraph (b) refers to those persons who work under a contract for services for the Identity and Passport Service in connection with the operation of the 2006 Act at premises located at the addresses which are listed in the Schedule to this Order, and hold a pass allowing unaccompanied access to those premises. Paragraph (c) refers to those persons who work under a contract for services for the Identity and Passport Service in connection with the operation of the 2006 Act at premises occupied by the Identity and Passport Service in a London borough, and hold a pass allowing unaccompanied access to those premises. Paragraph (d) refers to those persons who are employees or office‑holders and work in connection with the operation of the 2006 Act, and hold a pass allowing unaccompanied access to the premises occupied by the Secretary of State located at 2 Marsham Street, London SW1P 4DF.

Article 2(2) and (5) brings into force section 2(1) and (2), and section 5(1)(b), of the 2006 Act on 10th November 2009 in relation to British citizens and EEA nationals employed by Manchester Airport Group plc and holding a pass allowing unaccompanied access to Manchester Airport, or who hold employment or have been offered employment for which such a pass is required.

Article 2(3) and (6) brings into force section 2(1) and (2), and section 5(1)(b), of the 2006 Act on 24th November 2009 in relation to British citizens and EEA nationals employed by London City Airport Limited and holding a pass allowing unaccompanied access to London City Airport, or who hold employment or have been offered employment for which such a pass is required.

Article 2(7) brings into force on 20th October 2009 the provisions of the 2006 Act which are listed in that Article.
