9. In paragraph (1) of regulation 12(1) of the Principal Regulations—
(a)in sub-paragraph (c)(i) delete “or”;
(b)in sub-paragraph (c)(ii) for “the Charity Commissioners” substitute “the Charity Commission”(2) and at the end insert “, or”;
(c)after sub-paragraph (c)(ii) insert—
“(iii)in the case of a company that is a Scottish charity, a declaration that the Scottish Charity Regulator, and, where applicable, the Charity Commission, has given the company the written consent required by section 40 of the 2004 Act”.
