The Assured and Protected Tenancies (Lettings to Students) (Amendment) (England) Regulations 2009

The Secretary of State for Business, Innovation and Skills makes the following Regulations in exercise of the powers conferred by paragraph 8 of Schedule 1 to the Housing Act 1988(1).

Citation and commencement

1.  These Regulations may be cited as the Assured and Protected Tenancies (Lettings to Students) (Amendment) (England) Regulations 2009 and come into force on 30th October 2009.

Amendment of the Assured and Protected Tenancies (Lettings to Students) Regulations 1998

2.  Schedule 2 to the Assured and Protected Tenancies (Lettings to Students) Regulations 1998(2) is amended in relation to England by the insertion at the appropriate places of “Beach General Partner Limited” and “Beach Nominee Limited”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Schedule 2 to the Assured and Protected Tenancies (Lettings to Students) Regulations 1998 to specify Beach General Partner Limited and Beach Nominee Limited for the purpose of paragraph 8 of Schedule 1 to the Housing Act 1988. The effect of specification is that a tenancy granted by the body in question to a student at an educational institution specified in the 1988 Regulations is not an assured tenancy for the purposes of the 1988 Act.

An Impact Assessment has not been prepared for these Regulations as they will have no impact on the costs of business, charities or voluntary sectors. The impact on the public sector is minimal.
