The Air Navigation (Dangerous Goods) (Amendment) Regulations 2009

The Secretary of State makes the following Regulations in exercise of the powers conferred by article 70(1) of the Air Navigation Order 2005(1).

Citation and commencement

1.  These Regulations may be cited as the Air Navigation (Dangerous Goods) (Amendment) Regulations 2009 and come into force on 13th July 2009.

Amendment of Regulations

2.  The Air Navigation (Dangerous Goods) Regulations 2002(2) are amended by substituting for the definition of “Technical Instructions” in regulation 3(1)—

‘Technical Instructions’ means the 2009–2010 English language edition of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, as amended by Addendum No. 2/Corrigendum No. 1 dated 19th February 2009 and Addendum No. 3/Corrigendum No. 2 dated 24th March 2009, approved and published by decision of the Council of the International Civil Aviation Organisation(3);.

Revocation

3.  The following Regulations are revoked—

(a)the Air Navigation (Dangerous Goods) (Amendment) Regulations 2004(4);

(b)the Air Navigation (Dangerous Goods) (Amendment) Regulations 2005(5);

(c)the Air Navigation (Dangerous Goods) (Amendment) Regulations 2006(6);

(d)the Air Navigation (Dangerous Goods) (Amendment) Regulations 2007(7);

(e)the Air Navigation (Dangerous Goods) (Amendment) (No. 2) Regulations 2007(8);

(f)the Air Navigation (Dangerous Goods) (Amendment) Regulations 2008(9); and

(g)the Air Navigation (Dangerous Goods) (Amendment) (No. 2) Regulations 2008(10).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Air Navigation (Dangerous Goods) Regulations 2002. The definition of “Technical Instructions” is replaced by a definition referring to the 2009-2010 English language version of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, approved and published by decision of the Council of the International Civil Aviation Organisation, as amended by Addendum No. 2/Corrigendum No.1 and Addendum No. 3/Corrigendum No. 2.

The opportunity has been taken to revoke the earlier Regulations by which the definition of “Technical Instructions” has previously been amended from time to time.

An impact assessment has not been produced for this instrument as it has no impact on the costs of business.
