The Secretary of State makes the following Order in exercise of the powers conferred by section 108(3)(e) of the Clean Neighbourhoods and Environment Act 2005(1).
1. This Order may be cited as the Clean Neighbourhoods and Environment Act 2005 (Commencement No. 5) Order 2008.
2. The following provisions of the Clean Neighbourhoods and Environment Act 2005 come into force on 6th April 2008—
(a)section 68 (termination of police responsibility for stray dogs); and
(b)Part 6 of Schedule 5 (repeals, stray dogs).

(This note is not part of the Order)
This Order brings into force on 6th April 2008 section 68 of the Clean Neighbourhoods and Environment Act 2005, which repeals section 3 of the Dogs Act 1906, with savings for the purposes of section 2(2) and (3) of the Dogs (Protection of Livestock) Act 1953, and makes minor amendments to section 150 of the Environmental Protection Act 1990. It also brings into force Part 6 of Schedule 5 to the Clean Neighbourhoods and Environment Act 2005, which also repeals section 4 of the Dogs Act 1906, section 2 of the Dogs (Amendment) Act 1928 and section 39 of the Local Government Act 1988.
