3. In article 2 (costs to be taken into account in fixing driver licensing or vehicle registration fees)—
(a)in paragraph (2)(a), omit “and”; and
(b)after paragraph (2)(a) insert—
“(aa)the powers in section 99(7ZA) of the 1988 Act(1) (power to prescribe a fee for the renewal of a photocard driving licence);
(ab)the powers in section 105(2)(e)(2) of the 1988 Act (power to prescribe a fee for the issue of a driving licence in the place of a lost or defaced licence); and”.
i.e. the Road Traffic Act 1988 (c.52) in accordance with the definition of “the 1988 Act” in article 1 of S.I. 2003/2994. Section 99(7ZA) was inserted by the Road Safety Act 2006 (c.49), section 40.
Section 105(2)(e) was amended by the Driving Licences (Community Driving Licence) Regulations 1998 (S.I. 1998/1420), regulation 10.
