The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 10(1) and (2) and 12(1) and (2) of, and Schedule 3 to, the Superannuation Act 1972(1) with consent of the Treasury(2).

In accordance with section 10(4) of that Act, the Secretary of State has consulted such representatives of persons likely to be affected by these Regulations as appear to the Secretary of State to be appropriate(3).

Citation and commencement

1.—(1) These Regulations may be cited as the National Health Service Pension Scheme (Correction to Amendment) Regulations 2008.

(2) These Regulations come into force on 31st March 2008.

Amendment of National Health Service Pension Scheme (Amendment) Regulations 2008

2.—(1) The National Health Service Pension Scheme (Amendment) Regulations 2008(4) are amended as follows.

(2) In paragraph (2) of regulation 1 (Citation, commencement and interpretation), for “62(2) and (3)” substitute “66(2) and (3)”.

(3) The regulations following regulation 61 (insertion of new regulation S4A), numbered regulations 1 to 5 (which amend regulations T2A, U1A, U4 of, and Schedule 2 and 2A to, the National Health Service Pension Scheme Regulations 1995), are renumbered as regulations 62 to 66 respectively.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument amends the National Health Service Pension Scheme (Amendment) Regulations 2008 (S.I. 2008/654) (“the 2008 Regulations”).

Regulation 2(2) amends regulation 1(2) of the 2008 Regulations by substituting a reference to regulation 66(2) and (3) for the reference to regulation 62(2) and (3). Regulation 66(2) and (3) of the 2008 Regulations is to have retrospective effect from 1st April 2003 in accordance with section 12 of the Superannuation Act 1972 (c. 11).

Regulation 2(3) deals with the 5 regulations immediately following regulation 61 of the 2008 Regulations that are incorrectly numbered 1 to 5. Those incorrectly numbered regulations are re-numbered 62-66 respectively.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities or the voluntary sector.
