Coming into force

The Secretary of State makes the following Order in exercise of the powers conferred by section 43F of the Employment Rights Act 19961:

Citation, commencement and interpretation1

This Order may be cited as the Public Interest Disclosure (Prescribed Persons) (Amendment) Order 2008 and shall come into force on 6th April 2008.

Amendment

The Public Interest Disclosure (Prescribed Persons) Order 19992 is amended in accordance with article 3.

After the entry relating to Scottish Social Services Council, there shall be inserted the entries set out in the Schedule to this Order.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Public Interest Disclosure (Prescribed Persons) Order 1999 by inserting in the Schedule to that Order entries relating to the Children’s Commissioner and the Commissioner for Children and Young People in Scotland.

Section 43F of the Employment Rights Act 1996 provides a worker with the right not to suffer detriment, as a result of making a qualifying disclosure to a prescribed person in accordance with the requirements of that Act. The 1999 Order prescribes those persons and specifies the matters for which those persons are prescribed.
