The Dairy Produce Quotas (General Provisions) (Amendment) Regulations 2008

Coming into force

The Secretary of State is a Minister designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the common agricultural policy of the European Community.

These Regulations make provision for a purpose mentioned in that section and it appears to the Secretary of State that it is expedient for—

a

the references in these Regulations to—

i

Article 55(1)(a),

ii

Article 55(2), in so far as it relates to milk and other milk products, and

iii

the provisions of, or referred to in, Section III of Chapter III of Part II,

of Council Regulation (EC) No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation)3; and

b

the references in these Regulations to Commission Regulation (EC) No 595/2004 laying down detailed rules for applying Council Regulation(EC) No 1788/2003 establishing a levy in the milk and milk products sector4,

to be construed as references to those Articles and provisions and to that Commission Regulation as amended from time to time.

The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 19725.
