Proceedings before a civil court26

If the enforcing authority is of the opinion that proceedings against a person for an offence under regulation 27(1)(b) would afford an ineffectual remedy against that person, the enforcing authority may take civil proceedings against that person for the purpose of seeking such remedy as the enforcing authority believes is appropriate in the circumstances.

Civil proceedings under paragraph (1) may be taken—

a

in the County Court or the High Court; or

b

in Scotland, before the sheriff .
