The Secretary for Transport makes this Order in exercise of powers conferred by sections 20 and 12 of the Highways Act 19801 and now vested in him2:-

This Order may be cited as the A65 Trunk Road (From M6 Junction 36 to the Roundabout Junction with the A59) (Detrunking) Order 2008 and shall come into force on 31st January 2009 and 1st April 2009.

In this Order—

i

“the plan” means the plan, numbered HA 10/TD/026 and marked “A65 Trunk Road (From M6 Junction 36 to the Roundabout Junction with the A59) (Detrunking) Order 2008” signed by the Secretary of State for Transport, and deposited at DFT Records Management Branch, Ashdown House, St. Leonards-on-Sea, Hastings, East Sussex TN37 7GA;

“principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

iii

“the trunk road” means the A65 Trunk Road (A65).

The lengths of trunk road described in the Schedule to this Order shall cease to be trunk road and shall be classified as principal road from the dates on which this Order comes into force.

THE SCHEDULE

The lengths of the A65 trunk road ceasing to be trunk road are situated between the M6 Motorway Junction 36 in Cumbria (marked “A” on sheet 1 of the plan) to the boundary between the local authority areas of Lancashire County Council and North Yorkshire County Council (marked “B” on sheet 1 of the plan), and secondly, from the boundary between the local authority areas of Lancashire County Council and North Yorkshire County Council (marked “B” on sheet 1 of the plan) to the Roundabout Junction with theA59, West of Skipton, North Yorkshire (marked “C” on sheet 3 of the plan), and are shown by broad black dashes on the plan numbered HA10/TD/026. The two sections total approximately 58.92 kilometres (36.61 miles) in length.

This Order provides for that part of the A65 trunk road from the boundary between Lancashire County Council and North Yorkshire County Council to the Roundabout Junction with the A59, West of Skipton, North Yorkshire, approximately 43.66 kilometres (27.12 miles) in length, to cease to be a trunk road on 30th January 2009.

The Order also provides for that part of the A65 trunk road from the M6 Motorway Junction 36 in Cumbria to the boundary between Lancashire County Council and North Yorkshire County Council, approximately 15.26 kilometres (9.48 miles) in length, to cease to be a trunk road on 31st March 2009.
