Coming into force

The Secretary of State for Health makes the following Regulations, in exercise of the powers conferred by sections 16(3) and 52(1) of the Human Tissue Act 20041.

In accordance with section 52(8) of that Act he has consulted with the Welsh Ministers2 and the relevant Northern Ireland Department3.

Citation and commencement1

These Regulations may be cited as the Human Tissue Act 2004 (Ethical Approval, Exceptions from Licensing and Supply of Information about Transplants) (Amendment) Regulations 2008 and shall come into force on 29th December 2008.

Amendment of regulation 3 of the Human Tissue Act 2004 (Ethical Approval, Exceptions from Licensing and Supply of Information about Transplants) Regulations 20062

In regulation 3 of the Human Tissue Act 2004 (Ethical Approval, Exceptions from Licensing and Supply of Information about Transplants) Regulations 20064, in paragraphs (i) and (iii) of paragraph (4)(b), for “a licence under section 16(2)” substitute “a licence for the purposes of section 16(2)”.

EXPLANATORY NOTE

These Regulations amend regulation 3 of the Human Tissue Act 2004 (Ethical Approval, Exceptions from Licensing and Supply of Information about Transplants) Regulations 2006 (S.I. 2006/1260) by replacing the words, “a licence under section 16(2)” in regulation 3(4)(b)(i) and (iii) with “a licence for the purposes of section 16(2)”, in order to reflect more accurately, that section 16(2) does not authorise the granting of a licence.

A full impact assessment has not been produced for this instrument as it has no impact on the costs of business.
