The Secretary of State for Transport in exercise of the powers conferred by sections 82(2) and 83(1) of the Road Traffic Regulation Act 1984(1), having consulted with such representative organisations as he thought fit, hereby makes the following Order:

1.  This Order may be cited as the A27 Trunk Road (Southerham to Beddingham Improvement) (Derestriction and Revocation) Order 2008 and shall come into force on 10th November 2008.

2.  The A26 and A27 Trunk Roads (Beddingham)(40 Miles Per Hour Speed Limit) Order 2004(2) is hereby revoked.

3.  The lengths of the A26 and A27 Trunk Roads specified in the Schedule to this Order shall cease to be restricted roads for the purposes of section 81 of the Road Traffic Regulation Act 1984.

4.  In this Order:

“the A26 Trunk Road”means the A26 Trunk Road in the District of Lewes in the County of East Sussex from its junction with the A27 Trunk Road at Beddingham to Newhaven.
“the A27 Trunk Road”means the A27 Trunk Road in the said District and County from west of and including Southerham roundabout to east of and including Beddingham roundabout.

THE SCHEDULE

The lengths of A26 and A27 Trunk Roads to be a derestricted road are:-

  • A length of the A26 Trunk Road from its junction with the A27 at Beddingham roundabout southwards for a distance of 90 metres.

  • A length of the A27 Trunk Road between points 80 metres west and 170 metres east, of and including the roundabout at its junction with the A26 South Street (Southerham roundabout), a distance of 250 metres.

  • A length of the A27 Trunk Road between points 125 metres west and 350 metres east, of and including the roundabout at its junction with the A26 (Beddingham roundabout), a distance of 475 metres.

EXPLANATORY NOTE

(This note is not part of the Order)

The A27 Southerham to Beddingham Improvement is currently under construction between Southerham and Beddingham roundabouts south east of Lewes in East Sussex and is scheduled to be completed in Summer 2008.

The sections of the improved A26 and A27 Trunk Roads in the Schedule to the Order will have street lighting and therefore would automatically be subject to a speed restriction of 30 miles per hour. This Order will remove that 30 miles per hour restriction and impose the national speed limit. Sufficient road signs will be provided to make the speed limit clear to road users.

This Order also revokes the Order made in 2004 to impose on safety grounds, a 40 miles per hour speed limit on sections of A27 and A26 surrounding Beddingham railway level crossing which is no longer required following the permanent removal of the railway level crossing as part of the improvement works.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
