The Secretary of State for Environment, Food and Rural Affairs, being a Minister designated F1 for the purposes of section 2(2) of the European Communities Act 1972 F2 in relation to measures relating to the control and regulation of genetically modified organisms, makes the following Regulations in exercise of the powers conferred by that section.

Amendments (Textual)

F1S.I. 1991/755. Functions of the Minister of Agriculture, Fisheries and Food were transferred to the Secretary of State by virtue of the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).

Title and commencement

1.  These Regulations may be cited as the Genetically Modified Organisms (England) (Amendments) Regulations 2008; they come into force on 14th November 2008.

Amendments

2.  In regulation 8(1) of the Genetically Modified Organisms (Traceability and Labelling) (England) Regulations 2004 F3

(a)omit sub-paragraph (d);

(b)in sub-paragraph (e), before “7” insert “ 6 or ”.

Amendments (Textual)

3.  In regulation 8(1) of the Genetically Modified Organisms (Transboundary Movements) (England) Regulations 2004 F4, for sub-paragraph (d) substitute—

(d)without reasonable excuse to fail to comply with the requirements of a notice issued under regulation 7;.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Genetically Modified Organisms (Traceability and Labelling) (England) Regulations 2004 (S.I. 2004/2412) and the Genetically Modified Organisms (Transboundary Movements) (England) Regulations 2004 (S.I. 2004/2692) to correct errors.

No impact assessment has been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
