The Secretary of State makes the following Order in exercise of the powers conferred by section 29A of the National Lottery etc. Act 1993(1) and sections 25 and 36 of the Horserace Betting and Olympic Lottery Act 2004(2).
In accordance with section 29A(3) of the National Lottery etc. Act 1993 he has consulted each body mentioned in articles 3 and 4 of this Order, the Welsh Ministers(3), the Scottish Ministers, the Northern Ireland Department of Culture, Arts and Leisure and such other persons as he thinks appropriate.
In accordance with section 25(3) of the Horserace Betting and Olympic Lottery Act 2004 he has consulted each of the bodies for the time being mentioned in section 23 of the National Lottery etc. Act 1993(4).
In accordance with section 60(2) of the National Lottery etc. Act 1993(5) and section 36(4) of the Horserace Betting and Olympic Lottery Act 2004, a draft of this instrument was laid before Parliament and approved by resolution of each House of Parliament.
1993 c.39; section 29A was inserted by section 8 of the National Lottery Act 2006 (c.23).
The functions of the National Assembly for Wales under section 29A(3) were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c.32).
1993 c.39; section 23(1) was amended by S.I. 1994/1342, S.I. 1995/2088, S.I. 1999/2090, S.S.I. 2000/78 and S.I. 2007/743; section 23(2) was amended by S.I. 1996/3095, S.I. 1999/1563 and S.I. 2006/654; and section 23(4) was substituted for section 23(4) to (6) by section 15 of the National Lottery Act 2006.
Section 60(2) was amended by sections 8 and 19 of the National Lottery Act 2006.
