The Housing Benefit and Council Tax Benefit (Amendment) Regulations 2008

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 5(1)(a) and (h), 6(1)(a) and (h), 113, 122E(3), 189(1) and (4) to (6) and 191 of the Social Security Administration Act 1992(1).

The Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it(2).

In accordance with section 176(1) of the Social Security Administration Act 1992, the Secretary of State has consulted with organisations which appear to him to be representative of the authorities concerned(3).

Section 113 was substituted by section 60 of the Social Security Act 1998 (c.14) and was amended by paragraph 7(1)(c) of Schedule 6 to the Child Support, Pensions and Social Security Act 2000 (c.19). Section 122E was inserted by section 3 of the Social Security Administration (Fraud) Act 1997 (c.47). Section 189(1) was amended by paragraph 109 of Schedule 7 and Schedule 8 to the Social Security Act 1998, paragraph 57 of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c.2) and Schedule 6 to the Tax Credits Act 2002 (c.21); section 189(4) was amended by paragraph 109 of Schedule 7 and Schedule 8 to the Social Security Act 1998. Section 191 is an interpretation provision and is cited for the meaning of the word “prescribe”.
