The Defence Council make the following Regulations in exercise of the powers conferred upon them by section 2 of the Armed Forces Act 1966(1).
1. These Regulations may be cited as the Army Terms of Service (Amendment etc.) Regulations 2008 and shall come into force on 6th August 2008.
2.—(1) The Army Terms of Service Regulations 2007(2) shall be amended in accordance with paragraph (2).
(2) In regulation 11(2) (right to transfer to the reserve) after the words “date of enlistment” insert the words “or the person’s 18th birthday, whichever is the later”.
3. The Army Terms of Service (Part-time Service in Northern Ireland) Regulations 1992(3) are revoked.
4. The Army Terms of Service Regulations 2007 shall continue to apply without the amendment made by regulation 2 in relation to any person who enlisted in the regular army before 6th August 2008.

These Regulations amend the Army Terms of Service Regulations 2007 (“the 2007 Regulations”).
Regulation 2 provides for regulation 11(2) of the 2007 Regulations to be amended so that the calculation of the notice period, which a person who has enlisted in the regular army has to complete before exercising the right to be transferred to the reserve, begins with the date of the person’s enlistment or their 18th birthday, whichever is the later.
Regulation 3 revokes the Army Terms of Service (Part-time Service in Northern Ireland) Regulations 1992 consequent on the disbandment of the Northern Ireland resident battalions of the Royal Irish Regiment (to which they relate).
A full regulatory impact assessment has not been carried out for this instrument as it has no impact on business, charities or voluntary bodies.
