The Secretary of State makes the following Regulations in exercise of the powers conferred by section 105 of the Nationality, Immigration and Asylum Act 2002(1).
1. These Regulations may be cited as the Immigration (Notices) (Amendment) (No.2) Regulations 2008 and shall come into force on 1st August 2008.
2.—(1) The Immigration (Notices) Regulations 2003(2) shall be amended as follows.
(2) In regulation 2 (interpretation), in the definition of “immigration decision” after “section 82(2)” insert “and (3A)(3)”.
(3) In regulation 5(1)(b) (contents of notice), for “or (j)” substitute “,(j) or (3A)”.

These Regulations amend the Immigration (Notices) Regulations 2003 to ensure that certain provisions about the notice, content and service of immigration decisions apply where the Secretary of State decides that the automatic deportation provisions of the UK Borders Act 2007 (section 32(5)) apply to a person.

Section 82(3A) of the Nationality, Immigration and Asylum Act 2002 was inserted by section 35(3) of the UK Borders Act 2007 (c.30).
