The Secretary of State for Children, Schools and Families makes the following regulations in exercise of the power conferred by section 3(1) and (2) of the Education (Schools) Act 1997(1). In accordance with section 3(7) of that Act, the Secretary of State has consulted with such bodies as appear to him to be appropriate and representative of schools which provide assisted places under section 2(1) of that Act:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Education (Assisted Places) (Amendment) (England) Regulations 2008 and come into force on 1st September 2008.

(2) These Regulations apply in relation to a school year beginning on or after that date.

(3) These Regulations apply only in relation to England.

Amendment of the Education (Assisted Places) Regulations 1997

2.—(1) The Education (Assisted Places) Regulations 1997(2) are amended as follows.

(2) In regulation 10(4) and (6), for “£1,675” substitute “£1,745” in each place where it appears.

(3) In paragraph 1 of Schedule 2, for “£12,864” substitute “£13,397”.

(4) For the table following paragraph 2(1) of Schedule 2 substitute the following table—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Education (Assisted Places) Regulations 1997 (“the 1997 Regulations”) in respect of the school year beginning on or after 1st September 2008. The 1997 Regulations provide for the continued operation of the assisted places scheme in respect of pupils eligible to continue to hold assisted places by virtue of section 2 of the Education (Schools) Act 1997, notwithstanding the abolition of the assisted places scheme by section 1 of that Act.

The reductions to be made in relevant income in respect of dependent relatives pursuant to regulation 10(4) and (6) of the 1997 Regulations are increased from £1,675 to £1,745.

These Regulations amend the means test for the remission of fees: the level of income at or below which fees are to be wholly remitted is set at £13,397 instead of £12,864, with corresponding increases in the extent of remission where relevant income exceeds that sum.
