The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 61(1) and (2) of the Road Traffic Act 1988(1), and by virtue of the Department of Transport (Fees) Order 1988(2).

In accordance with section 195(2) of the Road Traffic Act 1988 she has consulted with such representative organisations as she thinks fit.

Citation and commencement

1.  These Regulations may be cited as the Motor Cycles Etc. (Single Vehicle Approval) (Fees) (Amendment) Regulations 2008 and shall come into force on 13th July 2008.

Increases in fees

2.—(1) The Motor Cycles Etc. (Single Vehicle Approval) (Fees) Regulations 2003(3) shall be amended as follows.

(2) In the regulations specified in column (1) of the Table below, for each amount specified in column (2) substitute the amount specified in column (3).

EXPLANATORY NOTE

(This note is not part of the Order)

These Regulations amend the Motor Cycles Etc. (Single Vehicle Approval) (Fees) Regulations 2003 (“the 2003 Regulations”). Those Regulations prescribe the fees which are payable in connection with applications for a Minister’s Approval Certificate and appeals under the Motor Cycles Etc. (Single Vehicle Approval) Regulations 2003 (“the Approval Regulations”). The Approval Regulations allow motor cycles, mopeds and other specified vehicles to be approved in terms of their design, construction, equipment and marking.

Regulation 2(2) increases the fees prescribed by the 2003 Regulations. The increased fees are set out in the Table below (with the percentage increase since the fees were last fixed shown in brackets).

The fee for a further application made within six months of the refusal of the original application remains unchanged at £16 (regulation 4(1) of the 2003 Regulations). The fee for the issue of a replacement for the original approval certificate, which has been lost or replaced, remains unchanged at £11 (regulation 8 of the 2003 Regulations).
