The Secretary of State for Innovation, Universities and Skills makes the following Order in exercise of the powers conferred by section 27 of the Further and Higher Education Act 1992(1) (“the Act”).

The Order is made with the consent of the further education corporation known as the Manchester College(2). It is made for the purpose of giving effect to a proposal for the dissolution of the further education corporations known as Manchester College of Arts and Technology(3) and City College, Manchester(4) (“the corporations”) made by the Learning and Skills Council for England. The Secretary of State has consulted each of the corporations.

1.  This Order may be cited as the Manchester College of Arts and Technology and City College, Manchester (Dissolution) Order 2008 and comes into force on 1st August 2008.

2.  On 1st August 2008 each of the corporations shall be dissolved and all of their property, rights and liabilities shall be transferred to the Manchester College, being a body corporate established for purposes which include the provision of educational facilities or services.

3.  Section 26(2), (3) and (4) of the Act shall apply to any person employed by any of the corporations immediately before 1st August 2008 as if the references in that section–

(a)to a person to whom that section applies were to a person so employed;

(b)to the operative date were to 1st August 2008;

(c)to the transferor were to the corporation in question; and

(d)to the corporation were to the Manchester College.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order dissolves with effect from 1st August 2008 the further education corporations established to conduct Manchester College of Arts and Technology and City College, Manchester. It provides for the transfer of the property, rights and liabilities of each corporation to the Manchester College and secures the rights of their employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.

An Impact Assessment has not been prepared for this instrument as it has no impact on the costs of business, charities or voluntary bodies. The impact on the public sector is minimal.
