The Membership of the Tribunal Procedure Committee Transitional Order 2008

The Lord Chancellor makes the following Order in exercise of powers conferred by paragraph 2 of Schedule 9 to the Tribunals, Courts and Enforcement Act 2007(1).

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Membership of the Tribunal Procedure Committee Transitional Order 2008 and shall come into force on 19th May 2008.

(2) In this Order “the Act” means the Tribunals, Courts and Enforcement Act 2007.

Lord Chief Justice’s appointees to the Tribunal Procedure Committee

2.—(1) The person listed as entry number 1 in the first column of the Table, being appointed as a legal member of the scheduled tribunal in the corresponding entry in the second column of the Table, shall be treated as falling within the sub-paragraph of paragraph 22 of Schedule 5 to the Act in the corresponding entry in the third column of the Table.

(2) The persons listed as entries number 2 and 3 of the first column of the Table, being appointed as the scheduled tribunal in the corresponding entry in the second column of the Table, shall be treated as falling within the sub-paragraph of paragraph 22 of Schedule 5 to the Act in the corresponding entry in the third column of the Table.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes transitional provision to allow certain persons who have been appointed to, or appointed as, a tribunal listed in Parts 1 to 4 of Schedule 6 to the Tribunals, Courts and Enforcement Act 2007 (c.15) (‘the Act’) to be considered a judge or a member of the First-tier Tribunal or the Upper Tribunal, as the case may be, for the purposes of paragraph 22(1) of Schedule 5 to the Act. That paragraph provides that the Lord Chief Justice of England and Wales must appoint judges and members of the First-tier Tribunal and the Upper Tribunal to the Tribunal Procedure Committee. The people listed in the Table in this Order will become eligible to be appointed to the Tribunal Procedure Committee despite the fact that their offices have not yet transferred into the First-tier or Upper Tribunals.
