The Secretary of State, in exercise of the powers conferred on him by section 2(2) of the European Communities Act 1972(1), being the Minister designated(2) for the purposes of that subsection in relation to the regulation and control, in the interests of conservation, of the import, export, landing, keeping, transportation and commercial display of, and trade in and disposal of, fauna and flora (including their parts and derivatives) and in relation to anything supplemental or incidental to those matters, makes the following Regulations.
1. These Regulations may be cited as the Control of Trade in Endangered Species (Enforcement) (Amendment) Regulations 2007 and come into force on 10th November 2007.
2.—(1) The Control of Trade in Endangered Species (Enforcement) Regulations 1997(3) are amended in accordance with this regulation.
(2) In regulation 2(1) for the definition of “Subsidiary Regulation” substitute—
““Subsidiary Regulation” means Commission Regulation No. 865/2006 laying down detailed rules concerning the implementation of Council Regulation No. 338/97”.
(3) In regulation 2(2)(d), for “Article 18” substitute “Article 17, 30 or 37”.
(4) In regulation 2(2)(f) for “Article 43” substitute “Article 72”.

These Regulations amend the Control of Trade in Endangered Species (Enforcement) Regulations 1997 by replacing the reference to Commission Regulation (EC) No. 939/97 with a reference to the current Commission Regulation (Commission Regulation (EC) No. 865/2006, OJ No. L166, 19.6.2006, p. 1) and making consequential changes to references to Article numbers of that Regulation.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
