1.—(1) This Order may be cited as the Portsmouth City Teaching Primary Care Trust (Transfer of Trust Property) Order 2007 and shall come into force on 1st November 2007.
(2) In this Order—
“the old Trust” means the Portsmouth City Teaching Primary Care Trust; and
“the trust property” means the property specified in the three schedules of trust property more specifically described in paragraphs (1) to (3) of article 2.
2.—(1) On the date that this Order comes into force the property specified in the schedule of trust property prepared and agreed by the old Trust and the Portsmouth Hospitals National Health Service Trust(3) and signed on behalf of the old Trust on 14th August 2007 and on behalf of the Portsmouth Hospitals National Health Service Trust on 1st August 2007, and any rights and liabilities arising from that property, shall be transferred from the old Trust to the Portsmouth Hospitals National Health Service Trust.
(2) On the date that this Order comes into force the property specified in the schedule of trust property prepared and agreed by the old Trust and the Hampshire Partnership National Health Service Trust(4) and signed on behalf of the old Trust on 14th August 2007 and on behalf of the Hampshire Partnership National Health Service Trust on 24th July 2007, and any rights and liabilities arising from that property, shall be transferred from the old Trust to the Hampshire Partnership National Health Service Trust.
(3) On the date that this Order comes into force the property specified in the schedule of trust property prepared and agreed by the old Trust and the Hampshire Primary Care Trust(5) and signed on behalf of the old Trust on 14th August 2007 and on behalf of the Hampshire Primary Care Trust on 26th July 2007, and any rights and liabilities arising from that property, shall be transferred from the old Trust to the Hampshire Primary Care Trust.
3. In any instrument relating to any of the trust property, any reference in relation to that property to the trustees of that property or to the old Trust, shall be construed as a reference to—
(a)in so far as the reference relates to property referred to in article 2(1), the Portsmouth Hospitals National Health Service Trust;
(b)in so far as the reference relates to property referred to in article 2(2), the Hampshire Partnership National Health Service Trust; and
(c)in so far as the reference relates to property referred to in article 2(3), the Hampshire Primary Care Trust.
