The Haringey Sixth Form Centre (Governing Body) Order 2007

Coming into force

The temporary governing body of Haringey Sixth Form Centre1 (“the School”) being treated as the governing body2, a qualifying body for the purposes of Chapter 1 of Part 1 of the Education Act 20023 (“the Act”), have, in accordance with section 4(2) of the Act, consulted such persons as appear to them to be appropriate.

It is the opinion of the Secretary of State—

a

pursuant to section 1(1)(a) of the Act, having regard to the matters set out in section 1(2), that the implementation by the governing body of the School of the provisions of this Order may contribute to the raising of educational standards in England, and

b

pursuant to section 2(5) of the Act, that this Order is not likely to have a detrimental effect on the education of children with special educational needs.

In exercise of the powers conferred upon the Secretary of State by section 2(1) of the Act4, the Secretary of State for Children, Schools and Families, on the application of the temporary governing body of the School, makes the following Order:

Citation and commencement1

This Order may be cited as the Haringey Sixth Form Centre (Governing Body) Order 2007 and comes into force on 22nd October 2007.

Exemption2

Regulations 12(3)(e) and (f), 13(1), 30(2) and paragraph 1 of Schedule 6 to the School Governance (Constitution) (England) Regulations 20075 are not to apply to the governing body of the School.

Time Period3

This Order has effect up to and including 31st August 2010.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under section 2 of the Education Act 2002. Article 2 exempts the governing body of Haringey Sixth Form Centre from the requirements in the School Governance (Constitution) (England) Regulations 2007 for the governing body to consist of certain numbers of governors falling within specified categories. It also exempts the governing body from the requirement that all governors must be aged 18 or over at the date of appointment or election. Article 3 provides that the Order has effect up to and including 31st August 2010.
