The Education (Listed Bodies) (England) Order 2007

The Secretary of State for Innovation, Universities and Skills makes the following Order in exercise of the powers conferred by sections 216(2) and 232(5) of the Education Reform Act 1988(1):

Citation, commencement, application and revocation

1.—(1) This Order may be cited as the Education (Listed Bodies) (England) Order 2007 and comes into force on 1st October 2007.

(2) This Order only applies in relation to England(2).

(3) The following Orders are revoked—

(a)the Education (Listed Bodies) (England) Order 2004(3),

(b)the Education (Listed Bodies) (England) (Amendment) Order 2005(4), and

(c)the Education (Listed Bodies) (England) (Amendment) (No 2) Order 2005(5).

Listed Bodies

2.  The bodies listed in the Schedule appear to the Secretary of State to fall, for the time being, within section 216(3) of the Education Reform Act 1988.

SCHEDULE

PART 1Bodies Providing Courses in Preparation for a Degree

SECTION 1Generally

SECTION 2In respect of foundation degrees only

PART 2Institutions of a University

EXPLANATORY NOTE

(This note is not part of the Order)

This Order lists the name of every body which is not a recognised body within section 216(4) of the Education Reform Act 1988 (the “1988” Act) but which appears to the Secretary of State either–

(a)to provide a course which is in preparation for a degree to be granted by such a recognised body and is approved by or on behalf of that body; or

(b)to be a constituent college, school, hall or other institution of a university which is such a recognised body.

‘Recognised bodies’ are universities, colleges or other bodies which are authorised by Royal Charter or by or under Act of Parliament to grant degrees and other bodies for the time being permitted by those bodies to act on their behalf in the granting of degrees.

This Order updates and replaces the list of bodies contained in the Education (Listed Bodies) (England) Order 2004 (S.I. 2004/2753) as amended by the Education (Listed Bodies) (England) (Amendment) Order 2005 (S.I. 2005/1382) and the Education (Listed Bodies) (England) (Amendment) (No.2) Order 2005 (S.I. 2005/2956). This Order revokes the 2004 Order and the 2005 Amendment Orders.

Part I of the Schedule to this Order lists all of those bodies that appear to the Secretary of State to provide courses in preparation for a degree, whether generally, as listed in section 1, or in respect of a foundation degree only, as listed in section 2. Part 2 of the Schedule lists all of those bodies that appear to the Secretary of State to be constituent colleges, schools, halls or other institutions of a university.

There are omitted from the Schedule to this Order a number of bodies that were listed in previous Orders but which no longer provide courses that are approved by or on behalf of a recognised body. The Schedule includes bodies that were not listed in previous Orders but which now provide courses that are approved by or on behalf of a recognised body. It incorporates other minor amendments and name changes. The Schedule reflects the restructure of the University of Wales from a federal to a non-federal institution, meaning that it no longer has constituent members listed in Part 2 of the Schedule.

A full Impact Assessment has not been produced for this instrument as it has no impact on the costs of business or charities.

By virtue of the National Assembly for Wales (Transfer of Functions) Order (S.I. 1999/672) and the Scotland Act 1998 (Consequential Modifications) (No 2) Order (S.I. 1999/1820) the powers conferred by sections 216(2) and 235 of the Education Reform Act 1988 are exercisable by the Secretary of State only in relation to England
