The Secretary of State is designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the assessment, management and control of environmental noise.
The Secretary of State makes these Regulations in exercise of the powers conferred by that section.
1. These Regulations—
(a)may be cited as the Environmental Noise (Identification of Noise Sources) (England) (Amendment) Regulations 2007;
(b)come into force on 20th September 2007;
(c)apply in England.
2. The table in Schedule 4 to the Environmental Noise (Identification of Noise Sources) (England) Regulations 2007(3) is amended as follows—
(a)omit the fifth entry (Gloucestershire, EGBJ);
(b)omit the eighth entry (London Biggin Hill, EGKB);
(c)omit the seventeenth entry (Shoreham, EGKA).

These Regulations amend Schedule 4 to the Environmental Noise (Identification of Noise Sources) (England) Regulations 2007 (S.I. 2007/415). Schedule 4 lists the major airports for the purposes of the Environmental Noise (England) Regulations 2006 (S.I. 2006/3228) which implement Directive 2002/49/EC of the European Parliament and of the Council of 25 June 2002 relating to the assessment and management of environmental noise (O.J. No. L 189, 18.07.2002 p. 12. Regulation 2 of these Regulations removes three airports (Gloucestershire, London Biggin Hill and Shoreham) from the table in Schedule 4.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
