The Lord Chancellor makes the following Order in exercise of the powers conferred on him by sections 1(8), 26(9) and 29(3) of the Judicial Pensions and Retirement Act 1993(1).

1.  This Order may be cited as the Judicial Pensions and Retirement Act 1993 (Addition of Qualifying Judicial Offices) (No. 2) Order 2007 and comes into force on 19th August 2007.

2.  In Part 2 of Schedule 1 to the Judicial Pensions and Retirement Act 1993 (offices which may be qualifying judicial offices), at the end of the list under the heading “Members of tribunals”, insert—

President of the tribunal constituted under section 9 of the Protection of Children Act 1999(2) or member of the chairmen’s panel appointed under paragraph 1(1)(b) of the Schedule to that Act.

3.  At the end of Schedule 5 to the Judicial Pensions and Retirement Act 1993 (retirement provisions: the relevant offices), insert—

President of the tribunal constituted under section 9 of the Protection of Children Act 1999 or member of the chairmen’s panel appointed under paragraph 1(1)(b) of the Schedule to that Act.

4.  In the Judicial Pensions and Retirement Act 1993 (Addition of Qualifying Judicial Offices) Order 2007(3) article 3 is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Judicial Pensions and Retirement Act 1993 by adding to the list of qualifying judicial offices in Schedule 1, and also to the list of relevant offices in Schedule 5, to that Act.

The offices of President and member of the chairmen’s panel appointed to the Tribunal established by the Protection of Children Act 1999 (commonly known as the Care Standards Tribunal) will become qualifying judicial offices for the purpose of the 1993 Act. Holders of qualifying judicial offices are entitled to a judicial pension under the 1993 Act if they hold their office on a salaried basis.

The President and members, both salaried and fee paid, of the chairmen’s panel will become relevant offices for the purpose of Schedule 5 to the 1993 Act so that the provisions about retirement dates in section 26 of the 1993 Act will apply to them.

This Order also revokes the provision in the Judicial Pensions and Retirement Act 1993 (Addition of Qualifying Judicial Offices) Order 2007 which precluded a person who was appointed to the office of Chief Asylum Support Adjudicator before 1st April 2007 from holding a qualifying judicial office for the purposes of the 1993 Act.
