Electricity

The Electricity (Standards of Performance) (Amendment) Regulations 2007

The Gas and Electricity Markets Authority (the “Authority”)(1) makes the following Regulations in exercise of the powers conferred by sections 39, 42A and 60 of the Electricity Act 1989 (“the Act”) (2).

In accordance with sections 39(1) and 39B(3) and (5) of the Act the Secretary of State has given his consent to the making of these Regulations.

In accordance with section 40B(1)(b) of the Act the Authority has published a notice of its intention to make these Regulations. No representations were made.

In accordance with section 40B(1)(c) of the Act the Authority has consulted the Gas and Electricity Consumer Council(3), electricity suppliers and persons and bodies appearing to be representative of persons likely to be affected by the Regulations.

Citation and commencement

1.  —These Regulations may be cited as the Electricity (Standards of Performance) (Amendment) Regulations 2007 and shall come into force on 1 August 2007.

Electricity (Standards of Performance) Regulations 2005

2.  —In regulation 3(1) (general interpretation) of the Electricity (Standards of Performance) Regulations 2005(4)—

(a)in the definition of “relevant supplier”, for “is in effect” substitute “had effect immediately prior to 1 August 2007”;

(b)in the definition of “supply services area” after “electricity supplier’s licence”, insert “immediately prior to 1 August 2007”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Electricity (Standards of Performance) Regulations 2005 (S.I. 2005/1019).

The definitions of “relevant supplier” and “supply services area” are amended consistent with the removal of condition 3 and Part D from the standard conditions of the electricity supply licence following the Gas and Electricity Markets Authority’s supply licence review.

1989 c.29: section 39 was amended by paragraph 32 of Schedule 6 to the Utilities Act 2000, sections 39A and 39B were inserted by section 54(2) of the Utilities Act 2000 and section 42A was inserted by section 58 of the Utilities Act 2000.

The Gas and Electricity Consumer Council was established under section 2(1) of the Utilities Act 2000.
