These Regulations are made in exercise of the powers conferred by section 2(2) of the European Communities Act 19721 and section 56 of the Finance Act 19732.
The Secretary of State for Environment, Food and Rural Affairs has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to the requirement for an assessment of the impact on the environment of projects likely to have significant effects on the environment3.C1
The Secretary of State for Environment, Food and Rural Affairs, with the consent of the Treasury, makes the following Regulations:C1
