The Pensions Increase (Armed Forces Pension Schemes and Conservation Board) Regulations 2006

The Treasury, in exercise of the powers conferred by section 5(2) of the Pensions (Increase) Act 1971(1) and now vested in them(2), make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Pensions Increase (Armed Forces Pension Schemes and Conservation Board) Regulations 2006 and shall come into force on 7th April 2006.

Interpretation

2.  In these Regulations—

“the 1971 Act” means the Pensions (Increase) Act 1971;

“conservation board” means a board established under section 86 of the Countryside and Rights of Way Act 2000(3).

Pensions to which the 1971 Act will apply

3.—(1) The 1971 Act shall have effect in relation to—

(a)any pension payable under the Armed Forces Pension Scheme 2005 (being a scheme made under section 1(1) of the Armed Forces (Pensions and Compensation) Act 2004(4)); and

(b)any pension payable under the Reserve Forces Pension Scheme 2005 (being a scheme made under sections 4 and 8 of the Reserve Forces Act 1996(5));

as if it were a pension specified in Part I of Schedule 2 to the 1971 Act.

(2) The 1971 Act shall have effect in relation to any pension payable by a conservation board under a scheme made under section 7 of the Superannuation Act 1972(6) (being the enabling power under which pension schemes are made for persons employed in local government service) as if it were a pension specified in Part II of Schedule 2 to the 1971 Act.

Explanatory Note

(This note is not part of the Regulations)

These Regulations apply the provisions of the Pensions (Increase) Act 1971 to any pension payable under the Armed Forces Pension Scheme 2005, any pension payable under the Reserve Forces Pension Scheme 2005 and any pension payable by a conservation board under the Local Government Pension Scheme or other schemes made under section 7 of the Superannuation Act 1972. The rate of any such pension is thereby increased annually in accordance with the Retail Prices Index.
